What happens if you buy a home and there is a problem with it? You may need to look at several items. First, you need to see what is in your sales contract. Does your contract say that there is a warranty? Does your contract say you have to go to arbitration, and you can’t go to court if you can’t agree with the other party?

What is arbitration? It is a procedure used to try to resolve your case. Sometimes it is binding, and sometimes it is non-binding. For either type you will have one or more persons who will decide your case after you present evidence. If binding, then you may not go to court after the arbitration, and the arbitrator’s decision is final. If arbitration is non-binding, then if you are not satisfied with the arbitrator’s decision, you may be able to go to court. These procedures may be varied by your arbitration procedure that you agreed to, or by the law.

How will I know what is causing the problem to my house? Sometimes you will need to hire an expert, who will work with your attorney about the legal aspects. If your garage walls are sagging or shifting, you may need to hire a civil engineer to analyze the structure. If your septic system or sewer system backs up, you may need to hire a geo-civil engineer for soils and other items involved with the flow of waste materials.

These are only examples with hypothetical procedures and experts, and are only some of the considerations involved. Your particular case will need to be analyzed to determine the procedures and types of experts, if any, which will apply.
